GENERAL TERMS AND CONDITIONS OF PUPPE URBAN CLOTHING FZCO
Scope, Definitions
The business relationship between PUPPE Urban Clothing FZCO, IFZA Business Park, 67071-001, Makani A1-3641379065, Dubai, UAE, represented by Ms. Raphaela Kruse (hereinafter the "Provider") and the customer (hereinafter the "Customer") is governed exclusively by the following General Terms and Conditions ("Terms") in the version applicable at the time of order. Deviating terms and conditions of the customer shall not be recognized unless the Provider expressly agrees to their validity in writing.
These Terms apply regardless of whether the Customer is a consumer or a business.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business is any natural or legal person, or partnership with legal capacity, who, when entering into the contract, acts in the exercise of their trade, business, or profession.
Conclusion of Contract
The presentation and advertisement of items in the Provider's online shop does not constitute a legally binding offer, but an invitation to the customer to make an offer (invitatio ad offerendum).
The Customer may select products from the Provider's range and add them to a so-called shopping cart via the "Add to Cart" button. By clicking "Order with obligation to pay," the Customer submits a binding offer to purchase the goods in the shopping cart. Before submitting the order, the Customer may review and amend the entered data at any time. The order can only be submitted if the Customer accepts these Terms by clicking the "Accept Terms and Conditions" button, thereby incorporating them into the offer.
The order can only be placed if the Customer accepts these Terms by checking the box "I accept the General Terms and Conditions."
The Provider will then send the Customer an automatic order confirmation by email listing the Customer's order, which can be printed. This confirmation merely documents that the order has been received and does not yet constitute acceptance of the offer.
The contract is only concluded once the Provider sends a separate order acceptance confirmation by email.
The text of the contract (consisting of the order, these Terms, and the order confirmation) will be provided to the Customer on a durable medium (email or printout) and stored in accordance with applicable data protection law.
The contract language is German and English.
Order Process and Correction of Input Errors
During the ordering process, the Customer may review and correct all entries (e.g. payment method, shipping details, or quantity) before clicking "Place Order." The Customer may cancel the order process at any time by closing the browser window.
Registration and Processing of Personal Data
Customers may place orders either as guests or as registered users. Registered users can log in for future purchases using their email address and password. Registration does not obligate the Customer to make a purchase.
The Provider collects and processes personal data (in particular contact details) in order to process orders. The Provider may use third-party providers to carry out credit checks. Further details can be found in the Provider's Privacy Policy.
Delivery Terms
Delivery times are calculated from the date of the order confirmation, provided payment has been received in advance (except where the payment method "invoice" is selected).
If no delivery time is specified in the online shop, delivery will take place within seven (7) days.
If the ordered product is permanently unavailable, no contract is concluded and the Customer will be informed accordingly.
Prices and Shipping Costs
All prices include applicable statutory VAT and are exclusive of shipping costs.
Shipping costs are displayed during the order process. Orders over EUR 150 are shipped free of charge.
Delivery is made by postal/courier service. The risk of shipping is borne by the Provider, provided the Customer is a consumer.
If the Customer exercises their right of withdrawal, they shall bear the cost of returning the goods.
Payment Terms, Set-Off, and Right of Retention
The purchase price is due immediately upon placing the order.
Available payment methods are debit/credit card, PayPal, or Klarna.
PayPal: Payment is processed via PayPal (Europe) S.à.r.l. et Cie, S.C.A., Luxembourg. PayPal's additional terms of use apply (see https://www.paypal.com/en/webapps/mpp/ua/legalhub-full).
Klarna: Payment options (e.g. invoice, installments, instant bank transfer) are provided by Klarna Bank AB (publ), Sweden. Klarna's terms apply (see https://www.klarna.com/international/terms-and-conditions/).
The Customer may only set off claims against the Provider that are undisputed or have been legally established. A right of retention only exists if the counterclaim arises from the same contractual relationship.
Retention of Title
The goods remain the property of the Provider until paid in full.
